ANTECEDENTS

 

Ecuador Volunteer Foundation is a non-profit organization that supports the development of voluntary programs in Ecuador with the aim, through voluntary work, of helping those sectors most in need in the fields of social/community work, education, and the environment.

 

ARTICLE 1

  • 1. Volunteers are responsible for both travel and health insurance.  Ecuador Volunteer Foundation is exempt from any responsibility for possible accidents and/or any physical and/or mental damage during the length of service of the volunteer.  Furthermore, the organization is absolved from any responsibility for possible theft that the volunteer may experience during his/her stay in Ecuador and/or on location.

 

ARTICLE 2

  • 1. The registration fee is non-refundable.
  • 2. Should the volunteer decide to leave (for any reason) the program before his/her end date expires, any monies outstanding will not be refunded.
  • 3. No monies will be refunded by Ecuador Volunteer Foundation should the volunteer decide to move from pre-arranged accommodation (host family, volunteer house, hostel, or other).  Any change to accommodation remains the sole responsibility, risk and cost of the volunteer.

 

ARTICLE 3

  • 1. Volunteers are required at all times to respect the ways of life of local people; this includes on location, in and around the host family’s residence and local communities, volunteer house, and hostels.
  • 2. Volunteers are expected to work the minimum agreed amount as required by a particular project.
  • 3. Volunteers are expected to participate in all tasks and activities assigned to them by the organization and its beneficiaries.

 

ARTICLE 4

  • 1 Ecuador Volunteer Foundation assumes responsibility for the arrangement of accommodation, information supplied, training of volunteers before the commencement of project/s, as well as ensuring any necessary preparations are made for said project/s.
  • 2. Every project, organization or foundation has a director and coordinator who are directly responsible for the supervision of volunteers.  Ecuador Volunteer Foundation does not have its own projects.  Therefore, the organization cannot interfere with the in-house rules, administration and/or workings of projects managed by beneficiaries.
  • 3. Responsibility for the well-being of volunteers lies with the volunteers themselves, project directors and coordinators.  Ecuador Volunteer Foundation cannot be held responsible for volunteers when they are on project grounds/location.
  • 4. Ecuador Volunteer Foundation, like similar organizations, forms part of a network that selects volunteers who offer their skills on a voluntary basis without expectation of monetary gain and/or salary.  Those projects most in need of volunteers, and set up by serious and responsible organizations that have a concrete structure in place to receive volunteers, form part of our network of beneficiary organizations.  However, we do not guarantee nor can we be held responsible for the actual management and/or operation of the project/s.
  • 5. It is the responsibility of volunteers to carry out duties assigned to them by project directors and/or coordinators.  In the case of any dispute or problem with the duties to be carried out, the volunteer is responsible for asking the project director and/or coordinator to modify, within reason and for good cause, said duties.
  • 6. Should the volunteer not wish to continue working on a particular project, he/she has the right to change project.  The volunteer should complete and submit a report explaining the reasons why he/she wishes to change projects and Ecuador Volunteer Foundation will automatically offer the volunteer the option to work on other projects.

 

ARTICLE 5

  • This document forms an agreement between both parties.  Any previous agreement, arrangement or understanding relating to the matter in this document is hereby rendered invalid.  All subsequent agreements, negotiations, and transactions relating to this document will be hereinafter considered as having been covered in this document.  Except from what is stated in this document, this agreement does not affect the rights of any person who does not form part of this agreement.

 

ARTICLE 6

  • The parties involved agree that, should a dispute and/or difference/s arise relating to this document, then an attempt should be made, in the first instance, to resolve it amicably.  Should parties be unable to resolve said dispute and/or difference/s, assistance should be sought from a mediator at the Arbitration and Mediation Center at the Chamber of Commerce in Quito.  Should resolution still not be possible, parties should submit a written complaint to an industrial tribunal, available from the Mediation and Arbitration Center at the Chamber of Commerce in Quito.

 

ARTICLE 7

  • In case of a dispute concerning the fulfillment or interpretation of this document, the parties hereby waiver jurisdiction, which based on residency might belong to them, and accept that which is contained in this document and agree to all its parts.
